§1 Preamble

This is the entire agreement between Flexiblers ("web portal") and user of Flexiblers web portal ("user"). The effective date of this Agreement is when user accepts this Agreement in accordance with the procedure of registration. By viewing, using or posting any materials on the web portal, or by participating in any partnership programs offered by web portal the user hereby acknowledges that he has read, is of full age, is familiar with, and agree to the terms and conditions of the web portal in their entirety.

§2 Services of web portal

The user acknowledges that the web portal is a matching service in UK and rest of Europe designed to assist:

• Carpool, daily commuters and hitchhikers trips by car or by train using a group ticket to find appropriate partners to share the ride.
• Selling of tickets for all types of transportation, among others: for train, bus and flights
• Entrainment of matters and objects
• Change of view between different users of web portal

§3 Costs

The web portal is providing this matching service for trips free of charge. Any agreement made between user and fellow users regarding cost sharing by trips or selling tickets does not involve web portal.

§4 Applicable laws

The user acknowledges that it is his responsibility to become familiar with the legalities of participating in a carpool in his country. Specifically, he acknowledges that it is his responsibility to contact his vehicle insurer and verify that he has sufficient insurance coverage to protect himself and his carpool passengers.

§5 Personal information

The user consents to web portal´s collection, use and disclosure of his full name, email address and phone number in order to provide this personal information to another users. The user may access, correct and delete his personal and trip information stored by web portal by using of "MyFlexiArea" or mailing of web portal administrator clicking the button "Contact us".

§6 Disclaimer of liability

The user acknowledges and agrees that web portal does not conduct, is in no way responsible for, and does not provide any warranty (express or implied) and/or guarantee of any kind with respect to, any background checks, including without limitation, any Criminal Record/Reference Checks, on the users of web portal. He acknowledges and agrees as well that it is his responsibility to contact, interview, research and select the carpool co-participants, vendors and buyers of tickets who are most appropriate for his needs. He acknowledges and agrees that none of the trip co-participants are in any way acting as transport companies, travel agencies or are acting in any other kind of similar relationship with commercial provider while conducting carpool services. He acknowledges and agrees that he will be using the information provided in this web portal at his own risk and that web portal and its Partners are in no way responsible, and provide no warranty (express or implied) and/or guaranty of any kind with respect to, the information provided herein.

§7 Waiver and Indemnity

In consideration of his becoming a member with this web portal, the user acknowledges and agrees to waive any and all rights to, or claims for, damages (including special and consequential damages), costs, expenses, proprietary or personal injury (including death), or any other compensation of any kind whatsoever against web portal represented by Flexiblers Company and its partners, including their president, vice-president, book-keeper or employees that arise directly or indirectly with respect to his use and/or reliance on the information provided in this Website, his membership with this web portal and/or his use of the Flexiblers services and agree to indemnify and hold harmless web portal and its partners, including their respective officials, officers, directors, employees, insurers and agents for same.

§8 Privacy Policy

The web portal respects user´s privacy. Flexiblers will not sell, or rent any data collected its site to others in ways different from what is disclosed in this agreement.
Flexiblers collects basic personal information when the user fills out the registration form. This information is used only to contact the user over the services on web portal for other users. Such personal information is stored on Flexiblers services and is accessed by authorized personnel only. The web portal uses IP-addresses and anonymized data to analyze trends, administer the portal, track user's movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. The log files are deleted on a monthly basis.

§9 Modification of Terms and Conditions

Web portal reserves the right to change these Terms and Conditions at any time without notice by posting the changes at out web sites. The user is responsible for regularly reviewing these Terms and Conditions. Continued use of Flexiblers after any such changes shall constitute user´s consent to such changes. Flexiblers does not and will not assume any obligation to notify the user of any changes to the Terms and Conditions.

§10 Final Provisions

The agreement is governed by and shall be construed in accordance with the laws of the Federal Republic of Germany. Should individual provisions of these General Terms and Conditions for Events be or become invalid or void, the validity of the remaining provisions shall remain unaffected thereby. In this case, the parties will agree upon a new provision being as close as possible to the sense of the invalid one.
